What is duty of care for waste?+
Under the Environmental Protection Act 1990, householders must take reasonable steps to make sure their waste is only handed to someone authorised to take it. That means checking a carrier is registered with the Environment Agency, not just trusting they are.
Can I really be fined for something someone else did?+
Yes. If you pass your waste to someone who isn't a registered carrier and it's later found fly-tipped, you can be held to have failed your duty of care — regardless of who physically dumped it. Local councils can issue a fixed penalty notice of up to £600, or pursue prosecution in more serious cases.
